The information included in this handbook will be helpful in answering most of your questions about procedures, policies, and regulations for your resort facilities or exchanging them for another resort.

The objective of your Board is to ensure each owner the best opportunity to accommodate his or her vacation requirement and to use all of the association resources in a fair and financially sound manner.

To this end, we have contracted with a resort management company to handle all of the operations and reservations of the resort.

VRI will maintain records of owners and their entitlements; such as; owner's status and unit size.

Purpose & Authority

The following rules and regulations are made for the safety and enjoyment of all owners of Powder Ridge Village (PRV). They are adopted by the Board of Trustees as provided for in the bylaws of PRV. PRV may enforce these rules and regulations by any or all of these methods: immediate fine, verbal warning, written warning, being asked to leave, no action or refer the matter to the Board for suspension of owner's privileges.

Owners are responsible for the actions of their guests and are financially responsible for the fees and fines of their guests. On site management may ask any non-owner (in other words a person of the general public), who is in violation of any of these rules and regulations, to leave the property. PRV may pursue trespass enforcement with appropriate law enforcement agencies.

The penalty for violation of any rule or regulation shall be a specific set fine or amount of damages whichever is greater unless a different penalty is specified. Penalties may be assessed for each violation, incident, or repetition of a violation.

PRV owners and guests must be eighteen (18) years of age or older to check into a unit. An adult must occupy the unit at all times.

Definitions
Owner: Anyone who owns one or more week(s) at Powder Ridge Village.

Owner in Good Standing: An owner with no outstanding fines, fees, or assessments and no delinquent contract payments.

Guest: An individual using resort facilities by personal invitation of an owner in good standing, or at the invitation of PRV. This includes children of the owner.

Reservation: 1) An advance request for occupancy of a unit, which has been accepted by the reservation office; 2) The period of days thereby reserved for occupancy by PRV owners.

Bonus Time: Available time used aside from or in addition to your week of ownership

Regular Time: A timeshare interval whereby the owner has purchased use of a floating week within a specified season (i.e. Prime/High/Swing).

Quiet Hours: Quiet hours shall be observed from 10 p.m. to 8 a.m.

Miscellaneous
Firearms: No firearms shall be allowed on resort property except as permitted by law.

Fires: Fires shall be built only in the barbecue grills provided using only charcoal briquettes. Grills shall not be permitted on the decks at anytime. No other material may be burned in the grills.

Fireplaces: Fires are only permitted with the use of the pressed logs. These logs may be purchased in the Lodge. No other material may be burned in the fireplaces. Violations of this policy will be subject to fine. *See Appendix for current fines.

Pet Policy: No pets of any kind are permitted in the units or around the Resort, except service animals after declaring upon check-in that the service animal will be in the unit. Violations of this policy will be subject to a fine and immediate removal of the pet from the property. * See Appendix for current fines.

Pool Rules: The rules are posted at the pool as well as in the unit guides in the unit. Any violation of the swimming pool policies may result in removal from the pool area.

Keys: The Manager shall retain a passkey to each unit. No owner or occupant shall alter any lock on any door leading into the unit.

Call Out: Any call-out of PRV personnel after hours for lost keys or any other thing of a non-emergency (not PRV's responsibility) nature will result in a fee. * See Appendix for current fees.

Resort Property

Common Elements
No halls, sidewalks, stairways, or similar areas of the project shall be obstructed or used for any purpose other than entrance to and exit from the units.

Personal Property
No stairways, sidewalks, grounds or other common elements of the project shall be used for the storage of any personal property.

Parking
No motor vehicle, trailer, or similar vehicle belonging to an Owner or Occupant, or their families, guests, tenants, or employees shall be parked in such a manner as to impede or prevent ready access to the parking areas. Parking is limited to two vehicles per unit.

Trash Disposal
Disposal of garbage and trash is the responsibility of the owner. All trash must be disposed of in common area trash and garbage facilities provided by the resort.

Removal of Resort Property
No owner or occupant shall be entitled to remove from their assigned unit furniture, furnishings, linens or other items of resort property contained in the unit. Violators of this policy will be charged a fine. *See Appendix for current fines.

Maximum Unit Occupancy
One bedroom unit - four (4) persons
Two bedroom unit - seven (7) persons
Three bedroom unit - nine (9) persons

Disorderly Conduct
A person is considered disorderly if he/she creates a hazardous or physically offensive condition, by an act which serves no legitimate purpose; intends to cause public inconvenience, annoyance or alarm; recklessly creates a risk by engaging in fighting, violent, tumultuous, or threatening behavior; makes unreasonable noises and/or engages in abusive or obscene language/gestures which can be heard/seen on the resort property.

Harassment
The Association will provide a work environment free from gender harassment, unreasonable demands and harassment from owners and guests and fellow employees. Harassment by or against the employees, owners and guests shall not be tolerated under any circumstances. Employees are entitled to respect and courtesy with no harassment when performing their duties in accordance with established rules, regulations, procedures or directions. Owners and guests are entitled to the enjoyment of their membership rights in accordance with established rules, regulations, procedures or directions.

Drug & Alcohol Use
No intoxicated person is permitted on the resort property except inside a unit. Any use of alcohol must comply with Utah State Law. Use of illegal drugs is not permitted anywhere on the property. PRV may authorize law enforcement agencies to search any area of the resort, including units in accord with local, state and federal statutes.

POWDER RIDGE VILLAGE TIMESHARE
ASSOCIATION ASSESSMENT, BILLING AND
COLLECTION (ABC) POLICY


The following is the Assessment Billing and Collection Policy for the Powder Ridge Village Timeshare Association as adopted by the Board of Directors.

ON OR AROUND SEPTEMBER 1
You will be mailed the approved Budget and Assessment Notice for the next year's assessment.

OCTOBER 1
Due date for the full amount if paying annually or due date for the first of eight (8) monthly payments. Payments are considered late if received after October 25.

ON OR AROUND OCTOBER 15
A reminder notice will be sent to owners who have not paid.

Monthly Payment Option
Owners have an option to either pay the assessment in full or in eight (8) equal monthly payments. If owners choose to pay monthly, a $40.00 fee for additional payment processing is added. The $40.00 monthly payment processing fee must be paid with the first monthly payment to be eligible for this option.

If owners choose to pay monthly, the first monthly payment is due October 1, 2008. Each monthly payment thereafter is due by the first of each subsequent month ending with the May 2009 payment. Monthly payments received after the 25th of the month are delinquent. Simply divide the total annual assessment by eight (8). This is your monthly payment amount. Add the $40.00 processing fee to the first month's payment.

DECEMBER 1
If the account is delinquent, the following charges are added to all accounts:A Reinstatement Fee of $50.00. Late payments are subject to a late charge of 5% not to exceed $20 of the billing for payments received after the 25th each month (Bylaws Article X, Section 10.2). An exchange, deposit, or confirmation cancellation fee of $25.00.

If you are delinquent, your reservations are canceled and you may not hold a reservation until your account is brought current. Exchange requests will not be confirmed. Existing confirmed exchanges will be cancelled. There is no guarantee you will receive a reservation or confirmed exchange after you have brought your account current.

ON OR AROUND JANUARY 1
You will be mailed a final Assessment Billing Notice, including all penalties, fees and interest. You must pay all charges in full within 15 days to have your occupancy and voting rights reinstated. Net proceeds are used to offset collection costs, assessment liens, foreclosures, and shortfalls in the HOA operating account.

If you are delinquent, your reservations are canceled and you may not hold a reservation until your account is brought current. Exchange requests will not be confirmed. Existing confirmed exchanges will be cancelled. There is no guarantee you will receive a reservation or confirmed exchange after you have brought your account current.

The Board of Directors may, at its discretion, submit delinquent accounts to an Attorney for formal notification of default and demand for payment (Legal Notice). The cost of Legal Notice will be added to delinquent owner's accounts.

The Board of Directors may, at its discretion, implement any of the following actions related to account delinquency. Any related costs for these actions will be added to the delinquent owner's account.

  a. Engage professional collection agencies to collect payment
  b. Pre-Notification of Lien & Record a Claim of Assessment Lien ($50 charge to delinquent owners account)
  c. Foreclose on the Claim of Assessment Lien
  d. Institute a Small Claims suit or other legal action

NOTE: A $25.00 charge will be added to your account for any payment that is not honored (bad check, insufficient funds, etc.). If the first payment is not honored for any reason subsequent payment including applicable late fees must be by secured funds (money order, cashier's check).

Reservation Information

Powder Ridge Village Owners may make reservations on first come first served basis, up to twenty four (24) months in advance at their home resort. Reservations may be made starting on the first business day of the month, 24 months prior to the desired reservation start date. All reservations are subject to availability. VRI will confirm reservations in writing as soon as possible, including resort address, resort telephone number, check in time, and maximum number of people allowed.

Reservation Procedures
Each owner has the following rights according to their type of ownership.

Prime: Winter:  Weeks 1-14, 47-52
High: Summer:  Weeks 22-41
Swing: Spring/Fall:  Weeks 15-21, 42-46

An owner in good standing is an owner who is current on his/her PRV maintenance and assessment fees. Any owner who is delinquent on PRV payments is not eligible to make a reservation within or outside of PRV.

All reservations MUST be made over the telephone, in writing, e-mail or by visiting the VRI Salt Lake City office. The VRI Reservations Department is open Monday through Friday from 8:00 a.m. to 5:30 p.m. and Saturdays from 9:00 a.m. to 2:00 p.m. via telephone only. (Mountain Standard Time) The office is closed on holidays.

Reservation Guidelines
Each week of Ownership is comprised of seven (7) nights: PRV Owners may request a reservation for occupancy, with the week commencing on Friday or Saturday. Unscheduled time cannot be carried over into the next year. An unused reservation (no show) cannot be carried over to any later period whether in the same year or different year.

Reservations can be divided into four increments:
Friday through Monday (3 nights)
Monday through Friday (4 nights)
Saturday through Tuesday (3 nights)
Tuesday Through Saturday (4 nights)

All reservations must be booked according to season and unit size of ownership. Owners cannot upgrade in season. Owners are allowed to upgrade in unit size 90 days prior to usage. *See Appendix for current fees. Owners are not guaranteed a specific unit, but will receive unit size according to ownership. Owners may down grade in season at any time.

Unscheduled time expires the last week of your season and is lost if not used.

Holiday Week Reservations
Powder Ridge intervals can only be scheduled every-other year during Holiday Weeks. Allowing every-other year scheduling will give a larger number of Owners access to resort bookings during these highly sought after Holiday Weeks. Holiday Weeks are defined as a week at the resort which contains New Year s Day, President s Day and Christmas.

Cancellation Procedures
Owners are allowed one (1) cancellation of their regular time. For each cancellation after one, a rebooking fee will be charged. *See Appendix for current fees.

If a reservation is canceled less than twenty-one (21) days to the date of the reservation, a cancellation fee will be charged upon cancellation. *See Appendix for current fees. If less than seven (7) days prior, no cancellations will be accepted.

Owners who are "no shows" for their confirmed reservations will lose their usage for that year.

Reservations During the Winter Season
The Powder Ridge road will be open and maintained 365 days of the year, however during the snow season owners are required to have 4x4 vehicles on the public highways and the Powder Ridge road to gain access to the PRV condominiums. PRV and VRI will not make concessions to owner reservations due to bad weather. PRV does have a 4x4 vehicle for staff use. Because of insurance liabilities, owners and their guests are not allowed access to the PRV resort vehicle except in the case of emergency. Only authorized PRV Resort staff must always drive.

Bonus Time Procedures
PRV owners may use additional time other than regular time. Bonus time is available to all PRV owners in good standing. Bonus time can be scheduled twenty-one (21) days or less prior to the desired start date with a one (1) night minimum. Fee is payable at time of booking and is subject to availability on a first come, first serve basis. *See appendix for current fees.

Bonus time cancellations must be cancelled seven (7) days prior to arrival date with a cancellation fee. *See Appendix for current fees. Remaining balance paid will be refunded. If cancelled less than seven (7) days there will be no refunds.

Exchange Procedures
Owners in good standing may schedule a seven (7) night reservation to deposit with VRI*ety, RCI or II by calling the VRI Reservations Department.

Satisfactory exchanges can be secured by banking the week as far in advance as possible. The maximum lead-time 18 months for VRI*ety and 24 months for RCI and II. Such reservations are subject to cancellation if the member becomes delinquent prior to the actual reservations date. All owners are expected to comply with specified rules and regulations at the exchange resort and exchange company.

On-Site Procedures

Snow Season User Fee
Owners who stay during the snow season will be charged a snow removal fee. This fee is payable upon check-in and is not negotiable. *See Appendix for current fees.

Check In/Check Out
Check-in is on Friday's and Saturday's from 4 p.m. to 9 p.m. Arrival at any other time requires special arrangements with the on-site personnel.

Check out is at 11 a.m. on your scheduled day of departure. Leave your key(s) at the check-in office, or in the drop box located in the front foyer of the Community Center. Please follow the on-site check out procedures as given upon check-in. Owners must make prior arrangements with the on-site personnel for any guests of the Owners to check- in without the Owner. Guests will be required to give a credit card imprint for any incidental charges.

Ski Lockers
Owners and guests must use the ski lockers to store their skis and skiing equipment. Skis and/or ski equipment are not allowed in the units. Any violation of this policy will be subject to a fine. *See Appendix for current fines.
